Public Consultation on Draft TRAC Arbitration Rules
Tehran Regional Arbitration Centre (TRAC) is pleased to inform that it is considering a new set of Arbitration Rules, to be published and be effective as of March 2018, after adoption by the Asian-African Legal Consultative Organization (AALCO). The new Rules will replace the TRAC Rules of 2005.
Similar to TRAC’s current Rules of Arbitration which is based on UNCITRAL Arbitration Rules (1976), the draft Rules is essentially based on the new edition of UNITRAL Rules (2010) with some modifications in order to make it suitable for institutional arbitration. In addition, considering the recent trends in international commercial arbitration and the business users’ needs, some innovative features are added to the draft Rules. In particular the draft Rules enjoys a mechanism for expedited procedure (Article 5), as well as the possibility of rendering emergency interim measures (Article 27 and appendix I).
TRAC is now opening the public consultation process on its draft Arbitration Rules of 2018 and invites all interested users and practitioners to review the draft Rules and send in their comments during the consultation period (18 January to 29 February 2016). TRAC welcomes all suggestions on the contents of the draft Rules, as well as any other issues and/or areas not already provided in the draft.
